Poor and unconnected cannot be a lawyer!
Related to country: India

Anaim feel severely restrained in the court premises, as if he was in enemy’s ground.

Anaim has been publicly manhandled and humiliated a score of times in court premises, in full view of public and slapped 4 to 5times by the court bullies. Humiliation also includes name-calling and crass and shameless accusationsin public. In the first week of March Mkhan nearly got his ghost out. Just outside, where court Nos 4 & 5 is situated a crowd of scores of small time mobile lawyers and litigants had gathered around. Mkhan again had created a scene. Anaim was standing near the courthouse waiting for a visitor. Seeing Mkhan Anaim stealthily tried to move away from his sight. But Mkhan would not let him go. He forcibly clasped his hand hard as if in hand shake and started manhandling him unprovked. They were both in uniform, one towering over the other. Addressing the crowd, which had gathered there, Mkhan swearing God’s name shouted“Khuda ki kasam this man has made some jahan pregnant. He has destroyed her life and chaste and that who is going to compensate her. She belongs to my place”

Anaim is a soft-spoken. Self-respecting and tongue tied lawyer and thoroughly a gentleman although poor and miserably unconnected. Anaim stammered and trembled. He could not speak out of shock and bended under the force of body, tongue, psychopathic disposition and behavior and colossal lies of Mkhan.

Akhan is unable to understand as to why Mkhan and other bullies are pursuing him with such single mindedness. His travails are too long and to many to be enumerated here.

Anaim took up the matter with New Delhi Bar Association office bearers several times. But every time he was told that he should not vitiate the matter for his own good.

Anaim is having illusions .At times in court he feels presence of Mkhan and other bullies around although they are not there. He hears his or their voice and when he turns it is somebody else.

Anaim says that once he got associated with a senior Skhan briefly upon his aggressive persuasions and temptations. No sooner he joined him he started forcing him to fetch him work that included first-time poor and anxious visitors who come to the court for various kind of work and also at nearby Ministry of External Affairs office.

Skhan attempted to involve him in various kinds of shady works. And that it is Skhan who is connected with racketeers in court that might have hired the bullies to fix him.
New Delhi Courts also known as Patiala House Courts is a court of elite jurisdictions in the the national capital of Delhi

Inside the court room in Delhi today.
Related to country: India

I struggled. I used my sides to cleave though the milling crowd, inside the small low ceiling, packed courtroom, meeting with thuds and clicks and angry glares of protestations. The blue padded low seats on either side were fully occupied. Petitioners, their family and friends, lawyers their juniors and associates, policemen, clerks and officials competed to have a foot hold between the rows of seats and little space left in front. Policemen inspectors and officials who had some business to be there jostled on the left side of so called podium, which is in fact a counter on a platform few inches above floor.
Apart form the milling crowd I was sickened by the cacophony of odd mixture of noises – constant squeaking of chairs, shuffling of papers, endless chattering of visitors, policemen seeking info from court staff, court staff seeking information from police court staff, seeking information from police officials and to add insult to injury the most distasteful – shuffling of shoes and sandals-come summer, the problem would be compounded by the heat and swishing and clattering of fans. The sound and action taking place, at few feet ahead at the counter where judge sat along with his staff- a small and cluttered place-appeared to be distant and muffled. After every disposal the shrill voice of the caller, calling the next name twice and thrice shot through and over- rode all.

The judge seemed oblivious of the atrocity of the environment. I cant say whether he was thoughtful, thoughtless or had simply resigned. I had seen the list hung outside there were sixty bail applications and forty regular cases to be dealt with. After hearing each argument nay speech he would put a sheaf of paper in the file and keep it aside: “ 2pm” “ 2.30pm” “3pm”. I went back to the court at 12.30 pm and finding the court deserted I enquired with one of the staff –whether the hearings were postponed. He told me that all the applications had been disposed of. At around I was informed that my application had been dismissed. “ No ground made out”: recovery to be effected.”
As I came out of the courtroom an old question assailed my mind: justice done or justice denied.

True Extortion story False Rape Case
Related to country: India

BrK raised his voice to a crescendo waving the paper in his left hand and pointing his left hand towards Mr. Singh Who was the complainant and had come to the court of Mr. Goel to depose his evidence .He said “ this man a few moment back outside gate no 3”” “he has molested this woman and tried to pull her into his car to outrage his modesty” The magistrate understood what it was all about. His lips parted into a smile. He took the copy of the complaint. Mr Singh received a bolt from the blue .He knew nothing of what had happened.
What had happened and eye witness account:
BrK commanded the woman Mai in his chamber to go to the woman lavatory and tear her shalwar from the front to remove the headband and get her hair bedraggled. He commanded brazenly and openly, his chamber being filled with juniors and clients and visitors. He commanded the woman to tear her blouse a little more and unsettle her hair more. He dictated the complaint to one of his juniors and asked him to get the complaint entered in Daily Diary at police station Tilakmarg.
At the same time he stationed two ruffians at the spot near gate no three to tell the policemen who would be visiting that they saw it.
Yes a case was registered against the gentleman for molestation and attempted rape. Mr. Singh was at hat time 65 years old, a proprietor of a departmental store at Okhla Industrial Area New Delhi. He was respectable gentleman with spiritual inclinationsn. Brk extorted hell lot of money.
Was it a poetic justice? A dispute arose between Brk and the woman with regard to the booty amount. The women lodged a complaint in the same police station against Brk for molestation and rape and blackmail the episode took a dramatic turn thereafter.

The Safe Business of Extortion in the Shadow of Court of Justice
Related to country: India

You can get it as low as as Rs. 200/- the fudged MLC for grievous injuries, simple hurt, and molestations from select city hospitals. Yes there is a channel- no to strangers- yes to racketeers and acquaintances. J.V got it, M. Khan got it, any body can get it. There is no one-way of fudging –not all I know. I know lawyers running extortion rackets are thick into it. Dispensation of justice is not a science. Law prohibits sifting of evidence at the stage of framing of charge, law prohibits sifting of evidence at the stage of bail arguments, law prohibits investigation before FIR and of course arrest. The truth is least likely to come out in cross-examination.
Investigation is not what you might think – digging the truth out in Arthur Conan Doyle style. It is just routine documentation and paper work according to Cr.pc and Punjab Police Rules. Neither they have the talent, nor the knack, nor time and space to dig out truth and never it happens.
If you do not hire a very talented lawyer who must also be inherently sincere and naturally committed to his work your chances of conviction is high. “You are innocent unless proved guilty “ is in the book. The truth is opposite. Once you are in the dock you are guilty, you are guilty in eyes of judge, in the eyes of Reader, typos naibcourt, court staff, lawyers and of course the world at large.
There are hundreds of people languishing in jail, and have languished with years in jail, with their Bail Applications dismissed by all courts in line, and lastly supreme court.
However there is one bright side to it that is full proof that is the safe business of extortion cheating and destroying your enemy safely and soundly and roundly for a fee or no fee!!!

Old Events: Caprice of a Senior Lawyer!
Related to country: India

Didn't know that time how important it is to be careful in filing Vakalatnama in civil cases and how risky it is. In case of negligence the party has an option to complain the Bar council with which you are registered for negligence and or misconduct. What may be morally and logically right may be legally wrong. You run the risk of being debarred and your dream shattered. A defendant hired my senior Mr. Syed. My Senior in answer to a summon to mark appearance, prepared the pleadings/briefs, that consisted of marking appearance, Application for Leave to Defend, Reply and Replication with lots of factual mistakes vis-à-vis documentary supports. He put my name everywhere, where it is required in the pleadings. He got me to identify the defendant in Affidavits before Oath Commissioner. And virtually pushed me Into the court of sub-judge. The court is situated at Tis Hazari quite far away from the court where he is having his chamber. You are supposed to mark your appearance and file Vakalatnama along with the defendant on this date. Then you receive another summon to apply for leave to defend. Which is followed by elaborate procedures of summoning for arguments on different occasions and filing of different types of application. It takes nearly a year. The humiliation and dishonor I faced at the hands of the honble judge in packed Court got etched in my memory with attendant distaste- it seems forever. besides the danger of complaint to Bar Council for professional misconduct. It was deliberate.

Many seniors here put their juniors and trainees to such travails and risk because they see them as future competitors.

Mysticsm and Upanishad!

The aim of Upanishadic teachers were to establish a way of knowledge to enable those who meditated in a certain way at length adopted a particular technique attained complete identity with Primal Being which underlies all existence.
The idea of complete identity is summed up in Chandogya Upanishad
“TAT TVAM ASI”
Meaning that individual soul has realized its identity with Brahman who is unqualified absolute.
When the above is realized then release from all the hampering conditions of life of Phenomenal World of Time and space, which is illusory, becomes possible. This is Nirvana the passionate peace.

Mystical creeds and revealed religion!

Eastern Mystical Creed
Religions not subscribing to the revelation through apostles of God bear too much resemblance to mysticism and Neo-platonism. Their attitude towards the end of man are to all intents and purposes the same as we find in mysticism i.e. meditation, asceticism, monasticism and unification or annihilation in Primal Being. They are grounded in an effort similar to mysticism finding out ultimate Reality through speculative consciousness penance and self-abnegation.

Neo-platonism and eastern mystical creed.

Neo-platonism and eastern mystical creed.
Plotinus (205-270) AD was the founder of this school. Plotinus philosophy was a way to union with God through moral purification and intellectual enlightment. It deeply influenced the intellectual world of Christian thinkers.
Athenian school of Neo-platonism was distinguished by its passionate paganism and by its taste for elaborate metaphysical speculation.
Proclus of Neo-platonism school of Athens is the principal source through which Neop-platonic ideas diffused to the Byzantine Islamic World and Medieval Latin West.
Proclus influenced Christian thought through Dionisus of Aeropagite.

Mysticsm Extra faculty for sporting!

We acknowledge that we have additional senses or faculties and that when we can develop them .We can discover many wonders and acknowledge that there are worlds other than our own unknown to specially suited for their perception.
But there is no evidence that any additional sense developed by us is in-corrigible, perfect and not self-deceptive .Our normal perceptions and knowledge derived through it is subjected to corrections and improvements. No wonder then we come across conflicting and contradictory statements in the experience of mystic’s theosophists and spiritualists. The differences are wider and more acute than those of different schools of philosophy
